2. Scope

These Terms govern your use of the THETA website and all services offered through it, including the generation of AI-assisted financial analysis reports (the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

3. Description of Service

THETA provides AI-generated financial analysis reports based on publicly available company information. The Service uses artificial intelligence (specifically, third-party large language models) to generate structured reports that may include valuation estimates, risk assessments, and financial data summaries.

The Service is provided for educational and informational purposes only.

THETA does not provide:

  • Investment advice or personal recommendations
  • Financial analysis within the meaning of MiFID II or WpHG
  • Portfolio management or asset management services
  • Brokerage or order execution services

THETA is not a licensed investment firm, financial advisor, or regulated entity. It is not supervised by BaFin or any other financial supervisory authority.

4. No Investment Advice

The reports generated by THETA are not investment recommendations. They do not take into account your personal financial situation, investment objectives, risk tolerance, or tax circumstances. You should not make investment decisions based solely on THETA reports. Always consult a qualified and licensed financial advisor.

5. AI-Generated Content — Limitations

All reports are generated by artificial intelligence. They may contain:

  • Factual errors or inaccuracies
  • Outdated information
  • AI-generated inaccuracies ("hallucinations")
  • Incomplete analysis
  • Biases inherent in AI training data

THETA does not guarantee the accuracy, completeness, timeliness, or suitability of any content. All valuation estimates are hypothetical scenarios, not predictions.

6. Subscription & Pricing

  • The Service is available via a monthly subscription at the price displayed on the website at the time of purchase.
  • All prices are final prices. VAT is not charged separately.
  • The subscription renews automatically each month until cancelled.

7. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access until that date.

8. Right of Withdrawal (EU Consumers)

If you are a consumer in the EU, you have a 14-day right of withdrawal. See our detailed Withdrawal Policy.

9. Intellectual Property

All content on the THETA website, including text, design, code, and generated reports, is protected by copyright. You may use generated reports for your personal, non-commercial purposes. You may not:

  • Redistribute, resell, or publish THETA reports as your own
  • Use reports for commercial advisory or financial services purposes
  • Scrape, automate, or bulk-download reports

10. User Obligations

You agree to:

  • Provide accurate information when using the Service
  • Not use the Service for any illegal purpose
  • Not attempt to circumvent any technical limitations
  • Not misrepresent THETA reports as professional financial advice to third parties

11. Limitation of Liability

To the extent permitted by law:

  • THETA is liable without limitation for damages caused by intent or gross negligence, and for damages resulting from injury to life, body, or health.
  • For slight negligence, THETA is only liable for breach of material contractual obligations (Kardinalpflichten), limited to typically foreseeable damages.
  • THETA is not liable for investment losses, trading losses, or any financial decisions made based on THETA reports.
  • THETA's total liability is limited to the subscription fees paid by you in the 12 months preceding the claim.

12. Data Protection

We process personal data in accordance with our Privacy Policy.

13. Contract Conclusion

The contract is concluded when you create an account and accept these Terms. For paid subscriptions, the contract is concluded when you complete the payment process. You will receive a confirmation email upon successful registration and upon each subscription payment.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days before the changes take effect by sending a notice to the email address associated with your account. The notification will describe the changes and your rights.

If you do not agree with the updated Terms, you may terminate your account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. You may terminate at any time; see Section 7 (Cancellation).

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this does not affect your mandatory consumer protection rights under the law of your country of residence.

For consumers: The courts at your place of residence have jurisdiction.
For businesses: Exclusive jurisdiction is Hamburg, Germany.

16. Dispute Resolution

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Severability

If any provision of these Terms is found to be invalid, the remaining provisions remain in full force and effect.
